Schenkungsvertr\u00e4ge ohne tats\u00e4chliche \u00dcbergabe, Ehepakte, Kauf-, Tausch- und Darlehensvertr\u00e4ge zwischen Ehegatten, bestimmte Rechtsgesch\u00e4fte von blinden Personen, bed\u00fcrfen zu ihrer G\u00fcltigkeit der Form des Notariatsaktes. Unter anderem ist auch im Gesellschaftsrecht und Fortpflanzungsmedizingesetz die G\u00fcltigkeitsvoraussetzung des Notariatsaktes vorgesehen.<\/span><\/p>\n<p><span data-text-color=\"secondary\">Der Notariatsakt ist eine \u00f6ffentliche Urkunde und ihm kommt daher erh\u00f6hte Beweiskraft zu.<\/span><\/p>\n<p>\u00a0<\/p>\n<p><span data-text-color=\"secondary\"><strong>Vollstreckbarer Notariatsakt?<\/strong><\/span><\/p>\n<p><span data-text-color=\"secondary\">Von besonderem Vorteil ist der vollstreckbare Notariatsakt. Wurde f\u00fcr eine Forderung ein vollstreckbarer Notariatsakt errichtet, muss die Forderung nicht m\u00fchsam und teuer eingeklagt werden, sondern kann sofort im Verm\u00f6gen des Schuldners vollstreckt werden.<\/span><\/p>\n<p>\u00a0<\/p>\n<p><span data-text-color=\"secondary\"><strong>Wie kommt der Notariatsakt zustande?<\/strong><\/span><\/p>\n<p><span data-text-color=\"secondary\">Da dem Notariatsakt als \u00f6ffentliche Urkunde besondere Beweiskraft zukommt, bestehen bei der Aufnahme des Notariatsaktes besondere Formvorschriften. So kann das Rechtsgesch\u00e4ft nur bei gleichzeitiger Anwesenheit aller Beteiligten vor dem Notar geschlossen werden. Der Notariatsakt bleibt beim Notar in Verwahrung und erf\u00fcllt so Beweissicherungszwecke. Die Vertragsparteien erhalten Ausfertigungen oder Abschriften. Den Notar treffen beim Abschluss eines Notariatsaktes besondere Belehrungs- und Beratungspflichten gegen\u00fcber den Parteien.<\/span><\/p>\n<p>\u00a0<\/p>\n<h4><span data-text-color=\"primary\">ELEKTRONISCHER NOTARIATSAKT<\/span><\/h4>\n<p><span data-text-color=\"secondary\">Seit Erlassung des BGBl. I Nr. 157\/2020 k\u00f6nnen Notariatsakte unbefristet auch in elektronischer Form errichtet werden. F\u00fcr die Errichtung eines digitalen\/elektronischen Notariatsaktes bestehen einige Besonderheiten.
