Legal representation of adults in times of COVID-19 (coronavirus)
Before registering a legal representation for adults, the notary must give a comprehensive personal instruction to the person concerned and the representative. The notary must also obtain a personal impression of the adult person to be represented and give him or her the opportunity to object to the registration of a legal representation of adults.
It has now been clarified that the hearing of the party can be conducted without the personal presence of the party using appropriate technical means of communication (e. g. via webcam and microphone, video telephony, etc. ). This means that in the event that a legal adult representative is to be registered for a mentally ill or similarly impaired person, this is in principle possible even without personal contact in times of COVID-19 and exit restrictions.
