The law states that if a person of full age who is suffering from a mental illness or is mentally handicapped is unable to take care of all or some of his affairs without risk of harm to himself, he shall, at his request or on his own initiative, appoint a trustee. If you wish to provide for this situation, it is possible to issue an order of trusteeship or a power of attorney before loss of business capacity. In the case of a non-custodial order, you name a suitable person whom you want the court to appoint as your non-custodial agent, or you name persons whom you do not want to be appointed as your non-custodial agent.

Mit der Vorsorgevollmacht können Sie eine oder mehrere Personen auswählen, die Sie im Vorsorgefall vertritt/vertreten (also für Sie entscheidet und handelt). Da der Vorsorgebevollmächtige anders als der Sachwalter vom Gericht nicht kontrolliert wird, sollten nur absolute Vertrauenspersonen bevollmächtigt werden. Sie können auch mehrere Personen bevollmächtigen, die sich gegenseitig kontrollieren.
