Online Notary: Digital authentication and certification
With the entry into force of the 4th COVID-19 Act, § 90a was added to the Notarial Regulations and thus the possibility of digital authentication and certification by the notary was created for a limited period of time until 31 December 2020. With BGBl. I No. 157/2020 this provision has been incorporated into the permanent law, so that digital notarial services can be performed indefinitely.
§ 90a der österreichischen Notariatsordnung besagt folgendes: Notare können die zu besorgenden notariellen Amtshandlungen unter Nutzung einer elektronischen Kommunikationsmöglichkeit (§ 69b) vornehmen, dies in sinngemäßer Anwendung von § 69b Abs. 2 und 3 der Notariatsordnung.
Diese Form der elektronischen/digitalen Beurkundung/Beglaubigung stellt eine Alternative zur herkömmlichen Vorgehensweise dar, bei der die Parteien persönlich vor dem Notar erscheinen müssen. Der Notar muss bei der elektronischen/digitalen Beurkundung/Beglaubigung mit der nicht physisch anwesenden Partei vor und während ihrer Signaturleistung unter Nutzung einer

Der Notar muss bei der elektronischen/digitalen Beurkundung/Beglaubigung mit der nicht physisch anwesenden Partei vor und während ihrer Signaturleistung unter Nutzung einer elektronischen Kommunikationsmöglichkeit durch eine optische und akustische Zweiweg-Verbindung ununterbrochen und solange verbunden sein, dass von ihm der Vorgang der Anbringung der elektronischen Signatur eindeutig und lückenlos mitverfolgt werden kann.
